1. Acceptance of Terms
By accessing or using Refund Rescue (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. The Service is operated by Refund Rescue ("we," "us," or "our") and is governed by the laws of the State of Texas.
2. Eligibility
The Service is available only to business entities located in the United States. By using the Service, you represent and warrant that you are authorized to act on behalf of a legitimate business entity and that you are at least 18 years of age.
3. Description of Service
Refund Rescue provides a software platform for preparing IRS Form 8849 and related fuel excise tax refund claims. The Service includes receipt scanning and data extraction via optical character recognition, equipment inventory management, form generation, and electronic filing through authorized third-party providers.
4. Not Tax or Legal Advice
THE SERVICE IS A TAX PREPARATION TOOL ONLY. WE DO NOT PROVIDE TAX ADVICE, LEGAL ADVICE, OR ACCOUNTING SERVICES.
The information and forms generated by the Service are based solely on data you provide. You are solely responsible for the accuracy and completeness of all information submitted, and for verifying that any forms generated are correct before filing. We strongly recommend consulting with a qualified tax professional or accountant regarding your specific tax situation.
5. User Responsibilities
You agree to provide accurate, current, and complete information when using the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
6. Subscription and Fees
6.1 Billing
Access to the Service requires a paid subscription. Subscription fees are billed in advance on a recurring basis according to your selected plan. Payment is processed through Stripe, and you authorize us to charge your designated payment method for all applicable fees.
6.2 Cancellation
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. Upon cancellation, your access to the Service will terminate and your data will be deleted in accordance with our Privacy Policy.
6.3 No Refunds
All subscription fees are non-refundable. No refunds or credits will be issued for partial subscription periods, unused features, or any other reason. You are responsible for understanding this policy before subscribing.
7. Intellectual Property
The Service, including its design, functionality, software, and content (excluding user-submitted data), is the exclusive property of Refund Rescue and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during the term of your subscription.
8. Prohibited Uses
You agree not to use the Service for any unlawful purpose, to submit false or fraudulent information, to attempt to gain unauthorized access to our systems, to reverse engineer or copy any aspect of the Service, to interfere with the operation of the Service, or to use the Service on behalf of any third party without authorization.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure, that defects will be corrected, or that the Service or servers are free of viruses or other harmful components. We do not guarantee the accuracy of any forms generated or the outcome of any tax filings.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, REFUND RESCUE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in subscription fees during the twelve months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Refund Rescue and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, your violation of any third-party rights, or any information you submit through the Service.
12. Third-Party Services
The Service integrates with third-party services, including payment processors and e-filing providers. Your use of these third-party services is subject to their respective terms and policies. We are not responsible for the acts or omissions of any third-party service providers.
13. Modifications to Service and Terms
We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We may also revise these Terms at any time by posting the updated terms on our application. Your continued use of the Service after any such changes constitutes acceptance of the revised Terms.
14. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately, and your data will be handled in accordance with our Privacy Policy.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of such courts.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Refund Rescue regarding your use of the Service and supersede all prior agreements and understandings.
